MA SJC Confirms Ruling Overturning Waterfront Rezoning

On Tuesday, the Supreme Judicial Court backed a lower court ruling confirming the state’s Secretary of Energy and Environmental Affairs does not have the jurisdiction to approve Boston zoning changes. The rezoning in question, affects two active proposals including Pinnable at Central Wharf, The Chiofaro Company's proposed 600-foot-tall development that would replace the Harbor Garage.

In a statement The Trustees of Harbor Towers Tower 1 and Tower 2 said, "we are gratified that the Supreme Judicial Court has affirmed the Superior Court’s decision in our favor in Harbor Towers’ challenge to the state’s approval of a plan for a 600-foot tower immediately on the Waterfront of Boston Harbor. We have always supported responsible redevelopment of the Harbor Garage, but the plan put forward by Prudential Real Estate and the Chiofaro Company was clearly inappropriate and inconsistent with Chap. 91 state law protecting the public’s access to the waterfront. We look forward to working with the city, state, and our neighbors on a plan that leads to better public access to the waterfront with better resiliency."

In response to the ruling, The Chiofaro Company tells BLDUP "We’ve received the decision and we are reviewing it.  We remain committed to the project and to advancing transformative improvements to the waterfront, including urgent and vital climate resiliency measures and opening up our portion of the waterfront for access to all."
