The referenced section of the currently adopted code has been revised in the 2021 International Mechanical Code as shown in the attached (Exhibit 1). The revised section provides exemption #3.2 which allows for the omission of fire dampers for duct penetrations at 1-hour or less rated fire barriers with the use of non-metallic duct sections in specific applications. 2) Is the requested modification is in compliance with the intent and purpose of the Construction Codes? YES EXPLAIN: The project meets the requirements of exemption 3 of the most recent versions of Section 607.5.2 in the 2021 IMC (Exhibit 1) which allows the omission of fire dampers at duct penetrations of 1-hour or less rated fire barriers when using a fully ducted system with the specific use of non-metallic duct work as outlined in exemption 3.1 and 3.2. 3) Does the requested modification lessen health, accessibility, life and fire safety, or structural requirements? NO
