EDENS Files Appeal Over Alley Easements at Union Market Development

EDENS has submitted an appeal of the ZA decision from June refusing to enforce a condition of approval for the 500 Morse Street project that would require LCOR to record sufficient easement agreements for access to a shared alley that will provide parking and loading access for all owners on the block. Additionally, EDENS has requests the Board hold a hearing as soon as possible so that a decision on the appeal can be made prior to the issuance of a final Certificate of Occupancy for the Morse Street development. According to the filing, EDENS attempted in good faith to work with LCOR and proposed many draft versions of the easements in hopes of reaching mutually acceptable terms. However, the LCOR Easements that have been recorded incorporate a number of conditions that impact EDENS’ ability to use the alley. The nearly complete development at 500-530 Morse Street features 279 luxury apartments along with nearly 20,000 square feet of retail space.
