[Please identify by specific citation to Title 12 of the DCMR or to the International Codes as applicable.] 2017 DCMR 12/A 2015 IBC SECTION 2902.2: SEPARATE FACILITIES District of Columbia Municipal Regulations Title 12 (DCMR 12), District of Columbia Construction Codes Supplement of 2017 ? 2015 International Building Code (IBC) as adopted by DCMR 12-A, Building Code Supplement ? 2015 International Plumbing Code (IPC) as adopted by DCMR 12-F, Plumbing Code Supplement ? The specific code section for which this Code Modification Request seeks an alternate method of compliance is IPC 405.3.2. 405.3.2 Public lavatories. In employee and public toilet rooms, the required lavatory shall be located in the same room as the required water closet. 1) Are there specific individual reasons that make the application of the strict letter of the Construction Codes impractical? If YES, Explain: Per DCMR 12A Section 2902.2 separate facilities for separate genders are required for Group A and B occupancies, unless single-occupancy gender-neutral public toilet facilities are provided. Per Section 405.3.2 of International Plumbing Code, all public restrooms are required to have the lavatories located in the same room as the water closets. The public plumbing facilities throughout the building will be grouped, gender-neutral restroom facilities with multiple toilet compartments (full height partitions) and shared lavatories. Since the lavatories are proposed to be adjacent to toilet compartments rather than within the same room as the water closet, a code modification is needed. For maximum flexibility, the principle of the Districts public accommodations law, an in recognition of recent design trends, multiple-occupancy toilet facilities with shared lavatories are being proposed for this building. 2) Is the requested modification is in compliance with the intent and purpose of the Construction Codes? If YES, Explain: The proposed code modification request is commensurate with the prescriptive requirements of the IBC and IPC when considering the following: ? The proposed configuration is reflective of changes in the 2021 editions of the IBC and IPC. The 2021 IPC adds an exception that allows gender-neutral, multi-compartment toilet rooms in lieu of requiring separate facilities for each gender. The exception states that toilets and lavatories must be designed for use by both sexes and privacy for toilets must be installed. The proposed gender-neutral restroom facilities will consist of multiple, single-user toilet compartments and shared lavatories. The toilet compartments consist of floor to ceiling stalls and doors to allow for privacy. ? The 2017 DC Building Code was amended to include a new exception to Section 2902.2 Separate Facilities. It allows the use of gender-neutral facilities that are single-occupancy if proper signage is provided. Although the facilities are multi-occupancy, all signage will reflect the gender-neutral requirements of the 2017 DC Building Code Section 2902.4. ? There are no requirements for lavatories to be private in the codes. Shared lavatories are already permitted in other occupancies in the District. ? Gender-neutral restrooms are becoming more prevalent as they allow for equitable access to all facilities for people of all genders. ? Current design trends in university facilities focus on providing gender inclusion while maintaining privacy and security. 3) Does the requested modification lessen health, accessibility, life and fire safety, or structural requirements?
