[Please identify by specific citation to Title 12 of the DCMR or to the International Codes as applicable.] DC PLUMBING COD...Building permit B2402058 - DINING HALL AT AMERICAN UNIVERSITY'S MARY GRAYDON CENTER. In accordance with Section 104.10 of the Construction Codes (Title 12 of the District of Columbia Municipal Regulations (DCMR)), I hereby request approval of the proposed modification of the following section(s) of the Construction Codes as applied to the above-referenced project/permit. [Please identify by specific citation to Title 12 of the DCMR or to the International Codes as applicable.] DC PLUMBING CODE 2017 SECTION 403.2 SEPARATE FACILITIES: WHERE PLUMBING FIXTURES ARE REQURIED, SEPARATE FACILITIES SHALL BE PROVIDED FOR EACH SEX. 1) Are there specific individual reasons that make the application of the strict letter of the Construction Codes impractical? YES In lieu of sex-segregated bathrooms, American University (the Owner) seeks to provide a group of gender-neutral single-occupant compartments, each with a water closet, and a shared gender-neutral semi-private area with lavatories in order not to discriminate against gender nonconforming occupants. There will also be a single toilet room with its own lavatory. Please see proposed bathroom layout attached. 2) Is the requested modification is in compliance with the intent and purpose of the Construction Codes? YES The intent of the code is to provide privacy for occupants while they perform toilet and activities. Providing a group of gender-neutral compartments, each with a water closet, affords at least the same, if not an increased, level of privacy as providing water closets in sex-segregated toilet rooms. Activates at lavatories, e.g.: washing hands, brushing teeth, etc, do not require the same level of privacy as activities involving water closets. Approval of this request will advance American Universitys goal to increase diversity, equity, and inclusion within the campus facilities.
