[Please identify by specific citation to Title 12 of the DCMR or to the International Codes as applicable.] DC PLUMBING CODE 2017 SECTION 403.2 SEPARATE FACILITIES: WHERE PLUMBING FIXTURES ARE REQURIED, SEPARATE FACILITIES SHALL BE PROVIDED FOR EACH SEX. The owner of this project would like the restroom facilities to be non-discriminatory and inclusive of all genders and identities, and non specifically segregated into female or male spaces. The project occupancy requires a total of 13 water closets and 7 lavatories. The proposes design features 2 multi-occupancy gender-neutral restroom facilities incorporating a total of 13 private toilet stalls (including 3 ADA-compliant stalls) and 9 lavatories in an open area. Additionally, 2 private unisex ADA restrooms are provided on the floor. Per 403.5, gender neutral signage will be provided. 1) Are there specific individual reasons that make the application of the strict letter of the Construction Codes impractical? YES The user group of this facility includes people that do not identify with a particular gender. The proposed restroom design ensures any individual can use the facility regardless of how they self-identify and not face discrimination. 2) Is the requested modification is in compliance with the intent and purpose of the Construction Codes? YES The intend of the code is to provide an adequate number of restroom facilities for the occupancy, and provide individuals with privacy to address their bodily and hygienic needs. The requested modification provides the required number of fixtures per Code and visual and acoustical privacy with each stall. Each toilet stall has floor-to-ceiling walls and solid door with locking hardware.
